A Bloomberg report on the tax deal mentions this odd provision: “A congressional staff member helping draft the legislation said the agreement would give people who died in 2010 a choice of tax treatment for the year: the 35 percent estate tax or a replacement capital-gains tax.”
Apparently the reporter made some calls to find out which option people would choose, but Alexander Haig, Lena Horne, Art Linkletter, Gary Coleman, George Steinbrenner, Theodore Sorensen, Jill Clayburgh, Dino De Laurentiis, Leslie Nielsen and Elizabeth Edwards could not be reached for comment.
